Florida Investment Advisor Sentenced to 5 years for Defrauding Investors

Tampa, Florida– Equity Star Capitol Management Owner Steven Zoernack, 55, of Sarasota, Florida Texas was sentenced to 60 months in federal prison by United States District Judge Susan C. Bucklew of the Middle District of Florida and ordered to pay $3,435,194 in restitution.

Steven Zoernack Pled Guilty to 1 count of Conspiracy to commit Wire Fraud in March 2017.

Zoernack was the Owner of Equity Star Capitol Management an investment advisory firm with offices in California and Florida. Zoernack was charged with the non-violent crime of Wire Fraud which is a federal crime pursuant to 18 United States Code Section 1343 and carries a maximum penalty of 20 years in custody and a fine of $1,000,00.00   

According to the 2017 U.S. Sentencing Guidelines, section § 2B1.1 for Larceny, Embezzlement and other Forms of Theft the Base Offense Level is “7”  for Wire Fraud charges with possible enhancements for multiple victims, more than minimal planning and abuse of trust, and an additional enhancement of 16 levels based a dollar loss of 3,435,194 in the indictment. Judge Susan C. Bucklew sentencing of Steven Zoernack is consistent with a sentence based on the Mid end of level 22 of the U.S. Sentencing Guidelines.

Custody advisor Larry Levine of Wall Street Prison Consultants and Custody Advisers has determined Zoernack’s sentence of 60 months in the custody of the Federal Bureau of Prisons should result in the defendant being awarded 235 days of Good Conduct time resulting in the defendant actually serving a total of 52 months at a Male Minimum Security (FPC) Federal Prison Camp with a possible additional 12 months of early release utilizing the (BOP) Bureau of Prison RDAP Program pursuant to 18 USC 3621(e); or additional 3 to 9 months of home confinement pursuant to the provisions of Second Chance Act of 2007.
